Welcome to Populens. These Terms of Service ("Terms") govern your access to and use of the Populens mobile application and related services (collectively, the "Service") provided by Da Vinci Software Bilişim A.Ş. ("Company", "we", "us"). Populens analyzes photos that users upload or select, provides visual reviews and ratings, and offers outfit (combination) suggestions and styling recommendations. By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
"User Content" means any photos, images, prompts, captions, reviews or other materials you submit to the Service. "Outputs" means images, ratings, style suggestions, or other content generated by our algorithms (including AI models) in response to User Content or inputs. "Third-Party Services" means services provided by external providers (e.g., cloud hosting, AI inference).
You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service. If you are under 18, you must have parental or guardian consent to use the Service where required by law. By using the Service you represent and warrant that you meet the eligibility requirements.
Certain features require creating an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activity under your account. Notify us immediately if you suspect unauthorized access to your account.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. You agree not to copy, modify, distribute, sell, or lease any part of the Service or attempt to reverse-engineer any part of the Service.
Populens uses automated tools and AI models to analyze images and produce Outputs such as aesthetic scores, quality assessments, suggested crops, and outfit recommendations. Outputs are for informational and entertainment purposes and do not constitute professional fashion or legal advice. We do not guarantee the accuracy of any Output.

We reserve the right to review, remove, or restrict access to User Content or Outputs that violate these Terms, our policies, or applicable law. We may suspend or terminate accounts for repeat violations. We do not guarantee we will monitor or remove content, but we may do so in our sole discretion.
Certain features are offered on a subscription or pay-per-use basis. Payments are processed through the applicable platform (Apple App Store, Google Play) or a third-party payment provider. All fees are non‑refundable except as required by law or the applicable platform policy. Subscriptions auto-renew until canceled per the instructions in the app or the platform store. You are responsible for all taxes associated with purchases.
We may use Third-Party Services for hosting, analytics, AI inference, or other operations. Use of such services is subject to the third party’s terms. We are not responsible for the privacy or security practices of third parties; consult their policies where applicable.
Our Privacy Policy explains how we collect, use, and share personal data, including images and derived data. By using the Service you agree to our data practices described in the Privacy Policy. Key points: we may store uploaded images temporarily to perform analyses and Outputs; we retain images and related data for no longer than 30 days by default unless required for legal reasons or as stated in the Privacy Policy.
You can request deletion of your account and personal data via the in-app settings or by contacting support. Following a deletion request, we will delete or anonymize your personal data within a reasonable time frame, typically within 30 days, subject to legal retention obligations.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY, ITS AFFILIATES OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO THE COMPANY IN THE SIX (6) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED TURKISH LIRA (TRY 100) IF YOU HAVE NOT PAID ANY AMOUNTS.
You agree to indemnify and hold the Company, its affiliates, officers, agents and employees harmless from any claim, demand, loss or damages, including reasonable attorneys' fees, arising out of or related to your use of the Service, your User Content, or your violation of these Terms.
These Terms and any disputes arising from them are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles. For users who are consumers, mandatory local consumer protection laws apply. Unless otherwise required, disputes will be subject to the exclusive jurisdiction of the Istanbul (Anadolu) Courts and Enforcement Offices.
We may modify these Terms from time to time. If we make material changes, we will provide notice in the Service or by other means. Continued use of the Service after notice constitutes acceptance of the updated Terms.
